Motor Vehicle Accidents

Every day in Ontario at least 2 people will be killed, and another 224 injured, as the result of motor vehicle collisions.

Very few people ever read their automobile insurance policies until they are involved in an accident. Even fewer people have read or understand the Insurance Act.

Following a car accident, there are two potential claims that you may advance.

The first is the so-called “no-fault” or Accident Benefits claim. As the name suggests, this claim can be advanced even if you were completely at fault for the accident.

The other potential claim is your tort claim or what is sometimes referred to as a "negligence" or "tort" claim. This is a claim against the person you feel is responsible for the accident and your resulting injuries.

Slip and Fall

If you have sustained an injury in a slip and fall accident, you may be entitled to compensation for:

  • Pain and suffering, referred to as "general damages."
  • Loss of income and loss of ability to earn income.
  • Housekeeping and home maintenance expenses.
  • Health care expenses not covered by OHIP or other sources.
  • Your entitlement to compensation for this type of injury will depend upon the circumstances of your fall.

Medical Malpractice

Doctors, nurses, and other health care practitioners make mistakes. If you are injured as the result of this type of mistake, you may be entitled to compensation for:

  • Pain and suffering, referred to as "general damages."
  • Loss of income and loss of ability to earn income.
  • Housekeeping and home maintenance expenses.
  • Health care expenses not covered by OHIP or other sources.
  • Other Injuries Not Listed

Not every type of injury falls neatly into one of the categories contained in this website. Many people suffer injury as a result of negligence of others. These injuries may include assault, wrongful death, and incidents of injury on premises owned by others. The losses that these victims suffer are no less serious than those who are injured in other types of incidents.

Most often persons causing injury have insurance policies which can be accessed on behalf of victims. There are varying time limits depending upon who caused the injuries and it will be very important that all facts are developed early so that limitation period problems can be avoided.

If you have been injured as the result of someone else’s negligence, you may be entitled to compensation.
